These terms and conditions of the website www.leccocucina.com, registered under Lecco Cucina LLP.. (here onwards referred to as Lecco Cucina), describe the terms on which the company offers you access to the website.
Lecco Cucina reserves the right to make changes to these terms at any time, and such changes will be effective immediately upon being posted on the website. Lecco Cucina is not liable to notify you of any changes made to the terms. Lecco Cucina reserves the right to modify, suspend or terminate your registration, the site, the service, or any feature or portion thereof at any time, without warning or notice, for any reason, at our sole discretion.

ELIGIBILITY

Use of the website is available only to person/s who can form legally binding contracts under Indian Contract Act, 1872, and any other applicable law for this purpose. If you are a minor i.e. under the age of 18 years, you shall not register as a member of the website and shall not purchase any items on the website. We reserve the right to cancel your registration if you are found to be a minor.

Subject to compliance with the Terms and Conditions of Lecco Cucina. Unless otherwise specified, the site and the service are intended for your personal, non-commercial use only. You agree to use the site and the service only for lawful purposes and acknowledge that your failure to do so may subject you to civil and criminal liability. You undertake not to: Defame, abuse, harass, threaten, or otherwise violate the legal rights of others; Impersonate any person or entity, or falsely state or otherwise misrepresent. You agree to adhere to all limitations on the dissemination, use, and reproduction of any materials like product designs, product catalogs, and more.

SITE ACCESS

Lecco Cucina may refuse, restrict, suspend, or terminate your access/registration to the site or the service at any time, without warning or notice, for any reason, at our sole discretion. You expressly agree that we will not be liable to you or any third party for modification, suspension, or termination of your access to the site or service, or any modification, suspension, or termination of the site or service itself or any feature or portion thereof. Certain features or options of our site and our service may require you to register or participate. If you choose not to register or participate, you may not have access to those features and options.

INTELLECTUAL PROPERTY RIGHTS

The trademarks ‘Lecco Cucina’ and/or ‘Lecco Cucina LLP.l’ shall at all times be Lecco Cucina’s property. You acknowledge that you have no right or property in the Trade Marks and names. You will ensure that the Trademark’s label or indicia relating to the branded products will not be misused. Any content of the website in the form of graphics, text, video, audio, catalogs, and others is owned or licensed by Lecco Cucina and if you are found using or reproducing the same, we may subject you to civil and criminal liability.

DISPUTE RESOLUTION

The parties shall make endeavors to settle by mutual conciliation any claim, dispute, or controversy (hereinafter “Dispute”) arising out of, or in relation to this agreement, including any dispute with respect to the existence or validity hereof, the interpretation hereof, the activities performed hereunder, or the breach hereof. Any dispute which cannot be resolved through such conciliation within 15 days or such extended period as the parties may agree shall be finally settled in accordance with provisions of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the “Act”), and any statutory modification or re-enactment thereof. The appointment of the sole arbitrator shall be in accordance with the Arbitration & Conciliation Centre – Bengaluru (Domestic & International) Rules, 2012. Such arbitration proceedings shall be conducted only in Bengaluru. The arbitration proceedings shall be conducted in the English language.

The arbitrator shall have powers to award and/or enforce specific performance. The arbitration award shall be final, and judgment thereupon may be entered in any court having jurisdiction over the parties or application may be made to such court for a judicial acceptance of the award and an order of enforcement, as the case may be.

Subject to resolving disputes by way of arbitration, the Courts of Bengaluru alone will have exclusive jurisdiction to decide disputes.

This website shall be governed and construed in accordance with the laws of India.
